Who we are
HappyNear is provided by Ahmet Kerem Yılmaz. You can reach us at hello@happynear.com. These terms apply to everyone who uses the happynear.com website, the HappyNear app and widget, and the business panel.
What HappyNear is
HappyNear is an app and widget that shows Happy Hours and deals at bars, cafés and restaurants nearby. Venues publish their deals through the business panel. The venue always offers and honours its own deals; HappyNear doesn’t sell, take orders or handle payments between guests and venues.
For guests
The app is free and needs no account. We work to keep deal information accurate, but the venue has the final word on a deal’s validity, hours and conditions. If you see a wrong or ended deal, you can report it in the app. The food, drinks and services at a venue, its hygiene and safety on its premises are entirely the venue’s responsibility; HappyNear is not a party to what you buy there. If something goes wrong, contact the venue first; if you also tell us, we review the deal and remove it if needed.
Photos you share
When you share a photo of a venue’s deal board, you let us use it to read the deal, publish it and show it to the venue for approval. The photo must be taken at the venue and must not show recognisable faces. Wrong or misleading photos can lead to a gift being cancelled and to your sharing being limited.
HappyPoints, gifts and surprise boxes
HappyPoints and gifts have no cash value; they can’t be exchanged for money, transferred or sold. Thank-you gifts and surprise-box gifts are given by venues and can be used once, only at the venue that gave them, within the stated period. We may cancel points and gifts if we find abuse. Point rules may change with prior notice.
Alcohol
Alcohol deals are only for people above the legal drinking age in their country and are not shown to under-18s. Where alcohol or alcohol promotion is banned (e.g. Türkiye), alcohol deals are not shown; venues’ food and coffee deals still are. You are responsible for stating your age truthfully; a false statement breaks these terms. Checking age and ID when selling alcohol is the legal duty of the venue that sells it. Please drink responsibly and never drink and drive.
For venues
Whoever signs in to the business panel confirms they own or are authorised to represent the venue. The venue is responsible for its deals being accurate, current and lawful, in particular for following alcohol sales and advertising rules. The venue must honour the HappyNear extras and gifts it offers. The venue alone is responsible for the safety of what it serves, for food and hygiene rules, and for age and ID checks when selling alcohol. The venue covers any claims, fines and costs brought against HappyNear because of these. We may remove wrong, misleading or unlawful deals and close the accounts of venues that repeatedly break these rules.
Paid plans and payment
The Starter plan is free. The Pro subscription, per-guest fees for HappyNear extras and Boost are paid; current prices are on the pricing page. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders and handles invoicing, taxes and payments. We announce price changes by email at least 30 days ahead.
Cancellation and refunds
Pro is monthly and you can cancel in any month; after cancelling you stay on Pro until the end of the month you paid for. See our refund policy for details.
Availability
We aim to run HappyNear without interruptions or errors but can’t guarantee it. Location, map and deal information may be delayed or incomplete. We may change the service, remove a feature or end the service with prior notice.
Limitation of liability
To the extent the law allows, we are not liable for indirect damages arising from the use of HappyNear. Our liability to a venue is limited to the amount it paid us in the last 12 months.
Changes
We may update these terms. We announce important changes on the website and by email to venues. Continuing to use HappyNear after a change means you accept the new terms.
Governing law
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İzmir have jurisdiction; consumers keep their statutory rights.
