Protection of Personal Data, Purpose of Explicit Consent Text and Our Company's Position as Data Controller

Our shopping site has the title of "Data Controller" within the scope of the Law No. 6698 on the Protection of Personal Data ("Law") in terms of personal data related to customers, and with this Personal Data Protection and Consent Text, it is aimed to obtain the explicit consent of the customers to be informed about the personal data processing activities carried out by our shopping site in accordance with the said Law.

With respect to the sales processes on the Website and Mobile Application, the Website and Mobile Application have the right to associate the behavior of users who come to the site with a cookie ("cookie") in the browser, even if they are not members, and to define "remarketing lists" based on metrics such as the number of pages viewed, the duration of the visit and the number of target completions in order to make online behavioral advertising and marketing. Within the scope of this law, the information collected during the membership process, through various forms and during shopping cannot be shared with third parties without the consent or knowledge of the user and cannot be sold for any reason. To whom and for what purpose can we transfer your personal data?

Within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law, it may be shared with Company officials, our affiliates, business partners, suppliers, shareholders, legally authorized public institutions and organizations and private institutions.

Our Shopping Site may transfer personal data to third parties within the country as well as abroad for the purposes stated above, provided that the conditions stipulated in Law No. 6698 are met.

Retention Period of Personal Data

Your personal data obtained through our communication channels (Site, Mobile Application, call center, e-mail, social media, etc.) are stored for the period stipulated in the relevant laws and regulations. If the laws containing the retention periods of personal data are not regulated within the period within the framework of Law No. 6563 and the relevant legislation, personal data are processed for the period required to be processed in accordance with the customs of personal data and commercial life, and then deleted, destroyed or anonymized. If the purpose of processing personal data has expired and the retention periods determined by the relevant legislation and the www.HappyNear.com website (''Site'') have come to an end; personal data can only be stored in order to constitute evidence in possible legal disputes or to assert the relevant right related to personal data or to establish a defense. In the establishment of the periods herein, the retention periods are determined based on the statute of limitations for the assertion of the right in question and the examples in the requests previously addressed to our website www.HappyNear.com (''Site'') on the same issues despite the expiration of the statute of limitations. In this case, the stored personal data is not accessed for any other purpose and access to the relevant personal data is provided only when it is required to be used in the relevant legal dispute. After the aforementioned period expires, personal data are deleted, destroyed or anonymized.

Rights of Customers as Personal Data Subjects

Pursuant to Article 11 of the Law, personal data subjects

(i) To learn whether personal data relating to them is being processed,

(ii) Request information if their personal data has been processed,

(iii) To learn the purpose of processing personal data and whether they are used for their intended purpose,

(iv) To know the third parties to whom personal data are transferred domestically or abroad,

(v) To request correction of personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

(vi) Although it has been processed in accordance with the provisions of the Law and other relevant laws, to request the deletion or destruction of personal data in the event that the reasons requiring its processing disappear and to request notification of the transaction made within this scope to third parties to whom personal data is transferred,

(vii) Object to the occurrence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems and

(viii) In case of damage due to unlawful processing of personal data, it has the right to demand the compensation of the damage.

In requests regarding the use of such rights, personal data owners can be communicated by the methods specified under Law No. 6698. Such requests will be evaluated and finalized within 30 days. Regarding the issues on this form, there may be changes in line with legal and technological developments.

In line with the explanations above, you can send your requests regarding your rights regarding the transfer of your personal data by our company to info@happynear.com by filling out the form in accordance with paragraph 1 of Article 13 of the KVK Law. Our company will evaluate and finalize the request within 30 (thirty) days at the latest depending on the nature of the request. 

Amendments

As HappyNear.com, we may change the provisions of this Clarification Text at any time by publishing it. The provisions amended by our Company shall take effect on the date of publication.
